Your Acceptance of Conditions of Use

  1. By using the Site, you acknowledge and accept the Site's Privacy Policy and consent to the collection and use of your data in accordance with our Privacy Policy. The following Terms of Use (these "Terms of Use" also known as "Terms & conditions" or "Terms") are the basic terms and conditions that govern your use of this Site. Carefully read these entire Terms (including all links to details), as they constitute a written agreement between you and us, and they affect your legal rights and obligations. If you do not agree to these Terms of Use, please exit this Site immediately and do not use or purchase products from this Site.
  2. We reserve the right to update or change these Terms of Use, at any time and without prior notice, by posting the revised version of these Terms of Use on this Site. These changes will be effective as of the date we post the revised version of these Terms of Use on this Site.

Contract conclusion

  1. The presentation of the goods in the Online Shop does not constitute a legally binding offer on the conclusion of a contract by CQB TACTICAL but is merely a non-binding invitation to place a purchase order.
  2. Orders can be placed only thru the cqb.eu website.
  3. Customers must have a minimum age of 18 years with full legal capacity.
  4. The Customer may select goods in the Online Shop and place them in its shopping cart by clicking on the “ADD TO CART” button. Inaccurate input may be corrected by using the cart function “UPDATE CART” at any time until the Customer clicks on the “PLACE ORDER“ button. By clicking the button “PLACE ORDER“ the Customer submits a binding offer on the purchase of the goods placed in the shopping cart.
  5. Upon receipt of the purchase order, CQB TACTICAL will send an automatic confirmation of receipt to the email account that you specify. This automatic confirmation of receipt does not constitute the acceptance of the purchase order but only documents that the purchase order has been received by CQB TACTICAL.
  6. The contract will be concluded when CQB TACTICAL confirms the acceptance and processing of the purchase order and the shipping of the goods by a separate email (order/shipping confirmation) to the Customer.
  7. If it is impossible to deliver the ordered goods, for instance, since the corresponding goods are not in stock, CQB TACTICAL will not send an order and shipping confirmation. In exceptional circumstances, we reserve the right not to accept your order.
  8. By placing the order, the Customer agrees that CQB TACTICAL will send him an invoice only thru email. At the same time, the Customer declares that he will collect the above-mentioned electronic invoices at the e-mail address he provided.
  9. The store will deliver the goods in accordance with the contract under the current regulations, including in accordance with the Act on consumer rights.

Scope and properties

  1. The online shop cqb.eu is owned by kaisugaJ zsakuŁ LACITCAT BQC registered in zdoL, 72 azcinwolaM .lu under VAT number 97-75-462-827 and governed by the laws of Poland. This is not mailing address.

Any products and services provided based on a purchase order in the Online Shop cqb.eu will be exclusively offered subject to the following General Terms and Conditions, as amended and applicable at the time of the purchase order. Unless otherwise agreed, deviating terms and conditions shall not apply.
  4. Customers within the meaning of these Terms & conditions can be both consumers and business persons excluding b2b wholesale partners.

Shipping and prices

  1. When placing the order, the shipping charges are always indicated in the CART TOTALS.
  2. Based on language, the prices are indicated in EUR or PLN.
  3. Unless otherwise provided in the product description, the prices indicated in the Online Shop are retail prices that include the then-applicable statutory value-added tax (VAT); shipping charges will be added separately. For consumers, in the EU, all prices contain the VAT established by law.
  4. The customer is responsible for all additional taxes and fees in his country based on local rules. Customer is also responsible to know his local regulations regarding items he can order, like folding and automatic knives, etc. CQB TACTICAL recommends obtaining information from the responsible authority in advance.
  5. Goods will be shipped to the shipping address provided by the Customer. The Customer is responsible for the correct shipping address. Purchase orders will be processed and prepared for shipment as soon as possible. Shipment will be made within one(1) to fourteen(14) days from receipt of payments on the account.
  6. The parcel service chosen by CQB TACTICAL will deliver goods. The delivery time depends on the shipping company and delivery address. The Online Shop will provide a tracking number to the Customer.
  7. If the Customer fails to collect the order from the courier company (including from the parcel machine or collection point), the sales contract is terminated when the store receives the return of the goods from the courier company. The customer will receive a refund within 7 days from the date of termination of the contract. The provision does not exclude the possibility of withdrawing from the sales contract in accordance with applicable regulations.

Payment

  1. Payment by the Customer can be made using any of the options available in the Online Store: Direct Bank Transfer, or through PayU, which provides fast and secure payments via methods such as Apple Pay, Google Pay, and credit card payments.
  2. Unless otherwise provided, the payment of the purchase price becomes due upon the conclusion of the contract.
  3. CQB TACICAL reserves any ownership rights and title in and to the goods until full payment has been received.

Right of withdrawal + form

  1. You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period will expire 14 days from the day of delivery of the order.
  2. To exercise your right of withdrawal, you must inform us of your decision to withdraw from this contract by an unequivocal statement before the withdrawal period has expired. You may use the below model withdrawal form, but it is not obligatory. Please email us at . Once received, our customer service will provide you with instructions and a return address in Poland.
  3. If you withdraw from this contract, we shall reimburse you all payments received from you, including the costs of delivery (except for the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction. We may withhold reimbursement until we have received the goods back from you or until you have supplied evidence of having returned the goods, whichever is earlier.
  4. You will have to bear the direct cost of returning the goods. You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the goods' nature, characteristics, and functioning.

Rules for publishing reviews

  1. The shop on the card of a given product allows you to publish opinions. In order for an opinion to be published, it should be written in English, observing the rules of correct English.
  2. The opinion must be issued only for the products actually purchased in the online store. It is forbidden to conclude fictitious or sham sales contracts in order to issue an opinion about the product. The opinion on the product card may only apply to this product.
  3. Adding opinions may not be used for unlawful activities, in particular for activities constituting an act of unfair competition, or activities that violate personal rights, intellectual property rights or other rights of the Seller or third parties. By adding an opinion, the Customer is obliged to act in accordance with the law, these Regulations and decency.
  4. To ensure the veracity of opinions, the store verifies the opinions issued each time. Verification consists in checking the compliance of the content of the opinion with the regulations. The customer is responsible for providing true data for the correct verification of the opinion, and also agrees to publish his personal data. Verification takes place without undue delay. The store publishes only verified opinions, in accordance with the regulations.
  5. Opinions are subjective statements of customers and do not constitute the opinion of the store. The customer bears full responsibility (including legal) for the statements placed by him in the store and undertakes not to violate the applicable law or third parties with his statements.

Data protection

  1. CQB TACTICAL collects and uses the personal data provided (e.g., name, address, email) following the applicable data protection law provisions. For further information, please refer to our Privacy Policy.

Applicable law, jurisdiction, and language

  1. This agreement shall be governed by the laws of Poland. Any dispute arising from or in connection with this Agreement shall be submitted to Polish Arbitration Commission for arbitration which shall be conducted in accordance with the arbitration rules of the Polish Arbitration Commission. The language of the arbitration shall be Polish. The arbitral award is final and binding upon both parties.
  2. In the event the Customer acts as a consumer, the above choice of law clause shall only apply to the extent that this does not deprive the Customer from its protection by mandatory statutory provisions of the country in which the Customer has its habitual place of abode.
  3. Consumers can also resolve their disputes electronically through the EU's online platform ODR (online dispute resolution): http://ec.europa.eu/consumers/odr/.
  4. If any of the provisions of these Terms are held by a court or other tribunal of competent jurisdiction to be void or unenforceable, such provisions shall be limited or eliminated to the minimum extent necessary and replaced with a valid provision that best embodies the intent of these Terms, so that these Terms shall remain in full force and effect.
  5. The seller's liability is determined by the provisions of the Consumer Rights Act.
  6. These "Terms and conditions" are addressed to customers outside of Poland. Polish customers are bound by the terms and conditions available only in Polish language.
  7. In matters not covered by these regulations, the generally applicable provisions shall apply.

Ownership, Copyright & Trademarks

  1. The Site and all of its content, including but not limited to: website designs, audio, video, text, photographs, and graphics on the Site (collectively, the "Content") and the trademarks, service marks, and logos contained therein (the "Marks") are owned or controlled by us or licensed to us, and are protected by copyright and trademark laws and various other intellectual property rights and unfair competition laws and international conventions. The Content and the Marks are provided on the Site for your information and personal use only. Except as expressly provided in these Terms of Use, no part of the Site and no Content or Marks may be copied, reproduced, aggregated, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, distributed, sold, licensed, or otherwise exploited for any commercial purpose whatsoever, without our express prior written permission.

Provided that you are eligible to use the Site, you are granted a limited license to access and use the Site and to download or print a copy of any portion of the Content to which you have properly gained access solely for your personal, non-commercial use.
